Pele takes Samsung to court after the company used a false image of him

Edson Arantes do Nascimento,  popularly called Pele, is suing South Korean electronics company Samsung for thirty-million dollars.

The company reportedly used a look-alike image of him in an ad on The New York Times and national TV.

The Brazilian soccer legend, filed a lawsuit at a Chicago federal court this month, through his attorney, Fred Sperling.

Sperling on behalf of the legend, claimed:

“Samsung used a Pele look-alike in an October advertisement for televisions.

The ad’s wording doesn’t mention Pele, but the elderly black man pictured in it “very closely resembles” Pele with a white soccer player, performing a “modified bicycle or scissors-kick, perfected and famously used by Pele.

The advertisement for ultra high-definition televisions also ran in the New York Times without Pele’s permission”.

The lawsuit said: “The ad will confuse consumers and hurt the value of his endorsement rights”.

The former New York Cosmos player who has endorsement deals with other companies, including Procter and Gamble, Emirates, Volkswagen, and Subway; seeks $30 million in damages.

The lawsuit said:

“The ad appeared after Samsung broke off negotiations to use Pele’s image in 2013.

Samsung pulled out of negotiations at the last minute “and never obtained the right to use Pele’s identity in any manner or in any format.”

Sperling represented former Chicago Bulls star Michael Jordan in August; a case which got the basketball star $8.9 million in damages.

Jordan had a legal battle with the former supermarket chain, Dominick, after it “improperly used his identity in a print ad”.

The footballer’s lawyer asserted:

“The goal is to obtain fair compensation for the unauthorized use of Pele’s identity and to prevent future unauthorized uses”.

Danielle Meister Cohen, a spokesperson for Samsung, confirmed that the company had no comment on the lawsuit; in an email, Tuesday.

He played Brazil’s victorious World Cup 1958 and 1970.

In 1999, he was voted World Player of the Century by the International Federation of Football History & Statistics (IFFHS).

The 75 year-old is the best player of all time, according to many. He was in the winning team for Brazil’s victorious World Cup of 1958 and 1970, scoring in both finals.

While playing for Santos he won the Copa Libertadores and Intercontinental Cup, twice. The football legend later became the face of “soccer” in the US.

Time magazine named him in their list of 100 most influential people of the 20th century

FRSC Warns Against Collection Of Driver’s Licence By Proxy

Featured Image

The Federal Road Safety Corps (FRSC) has on Wednesday cautioned the general public against obtaining the driver’s licence by proxy as it urged prospective applicants to obtain the document through due process.

The caution was made known by the Corps Marshal of the FRSC, Mr Boboye Oyeyemi, during a one-day workshop organised for the Corps Heads of Driving License Centres.

“There will be no more collection of driver’s licence by proxy; prospective applicants will have to come by themselves and be captured to avoid obtaining fake license.

“Also, fresh applicants must obtain permit from an approved driving school and undergo all necessary processes before they will be issued the document,’’ Oyeyemi said.

Oyeyemi also said the issue of integrity of driver’s licence was raised when the corps visited the National Assembly recently, assuring that the corps was poised to tackle the issue of fake licence.

The corps marshal restated that the document could be obtained with only N6, 350 and advised applicants to report any personnel of the corps who demanded more than the amount.

Mihajlovic: Balotelli Must Do More

Featured Image

AC Milan manager Sinisa Mihajlovic wants Mario Balotelli to do more, after praising him for his perfect behaviour.

Balotelli returned to the Serie A on a season long loan from Liverpool and has three goals from 16 appearances.

This week has seen the Italy international been linked with a move to China, with his Europe career hitting a wall.

Mihajlovic, however, is confident Balotelli can still prove a top player for Milan after praising him for keeping his off-the-field indiscretions to a minimum.

“His behaviour has been 10 out of 10 this year,” he told Sky.

“I was blunt with him,” Mihajlovic added when questioned about a recent meeting between the pair. “I wanted to talk to him and look at him, because I’ve known Mario since Roberto Mancini gave him his Inter debut.

“He was a kid then. Many years have passed and he’s changed, too. I found a mature person, a man, not a boy.

“I wanted to look him in the eyes, and he gave me the right impression. The key thing is that he’s a good lad, and I really like him.

“He knows he’s made a lot of mistakes, he’s the first to admit that. It’s true that everything is amplified when it comes to him, but it’s also true that he brings a lot of that onto himself.

“He has to do more on the pitch, but he knows that as well and we’ve often talked about it. I’m certain we’ll succeed.”

Hecking: Wolfsburg Can Shock Real Madrid

Featured Image

Wolfsburg coach Dieter Hecking believes his side can cause a upset and shock Real Madrid in the UCL.

The bundesliga club are playing in the UCL for only the second time in their history and qualified for the last eight by beating Gent over two legs.

Hecking would have preferred to draw Benfica in the quarterfinals, but is pleased to see Wolfsburg face the best.

“From a sporting point of view, I would have preferred Benfica, because that would be a 50-50 tie. But then there is the glamour of Real Madrid,” he said.

“I think we can succeed if we don’t show too much respect for Real Madrid, the club and their individual players. They are a team just as we are, and we have to try to make it as difficult for them as possible with what we have.

“You have a chance in any match. We are big underdogs in this tie, but outsiders are there to be cheeky, and I would like to see my team doing that in both matches.

“Anyone who knows Real Madrid knows their strengths. They have great quality in attack and have shown that in the Champions League. They’ve won seven of their eight matches this season, so we’re facing great quality, but we shouldn’t underestimate ourselves as we also have something to offer. I hope we can show that.”

Hecking added that it has been a “special experience” for Wolfsburg – who are eighth in the Bundesliga – to reach this stage of the Champions League.

“It was a special experience for the club and for the fans, but also for the team. It’s also a milestone for me in my career,” he said.

“Now we are in with the ‘creme de la creme’ of Europe – we have to face the teams who have dominated Europe in recent years. And we’re part of that with Wolfsburg, from a city of 120,000. That’s extraordinary for the club.

“It is a huge amount of fun to play in the Champions League. Every single game has been a highlight. It’s a massive experience and an experience that I don’t want to miss out on.

“We deserve to be in the quarter-finals, we’re having a great season in the Champions League, so let’s see what we’ve still got in store.”

Gotze Urged To Leave Bayern For Dortmund

Featured Image

Bayern Munich legend Lothar Matthaus has advised midfielder, Mario Gotze to return to former club Borussia Dortmund.

The Germany international left Dortmund for Bayern in 2013, but has struggled to make an impression.

And with Dortmund looking to get him back and Liverpool also in the run for his signature, Matthaus has urged him to consider a return to BVB.

“Gotze back to Dortmund would simply be a good fit,” Matthaus wrote in his column for Sport Bild.

“Our World Cup hero is a child of the Borussia Dortmund academy. He might have ruined it for some fans following his move to Bayern, but I feel he does not owe anyone an apology over his decision to go for a new challenge elsewhere.

“Things unfortunately didn’t pan out as everybody expected. But both Gotze and Dortmund know from each other what they bring to the table. He will soon win the fans over again after his first few goals for BVB.

“Would a return to Dortmund mean he has failed at Bayern? I think that would be harsh to say. He won two Bundesliga titles with Dortmund and he will win his fifth title in total if Bayern win it this season. These successes with Bayern, in which he had a hand, prove him right for joining them. But it’s also a fact that he has been unable to become a undisputed starter like Thomas Muller.

“The reason behind all this is not just Gotze’s quality or his mentality. The marriage between Gotze and Bayern was a misunderstanding right from the start.”

Buffon To Retire From Football At 40

Featured Image

Veteran goalkeeper Gianluigi Buffon has revealed his plans for the future, as he intends to retire at 40.

The 38-year-old shotstopper, who has won six scudettos and a world cup over his 22 years long career is still first choice goalkeeper for both club and country.

Buffon also stated he has no desire to go into coaching and would love to scout when he’s done.

He said: “After this year, I will play for two more seasons before quitting. I do not want to play after 40 years, but I want to get to 40 years.

“Even if I were to be offered twice the salary elsewhere, I would stay at Juve for life. Being part of it makes me proud, because it has a value. And now certain values seem out of fashion.

“I have a wealth of experience, but I do not want to coach. I rather like the role of recruiter. They are ambitious. I would go to nations like the United States or China, which have great potential for a large population.”

He added: “If I do something, I do it with the idea to get to the top – without that I would stop living.”

Eboue Banned From Football For A Year

Featured Image

Sunderland defender Emmanuel Eboue is facing a ban from all football related activities for a year, due to his refusal to pay his former agent Sebastien Boisseau.

The Ivorian defender was ordered by the single judge of Fifa Players’ Status Committee to pay the money owed, but he opted to appeal the decision at the Court of Arbitration for Sports (CAS).

Eboue’s appeal has since been dismissed, though, and the decision of the Disciplinary Committee confirmed in full, meaning he now faces one year on the sidelines unless he pays the total outstanding amount owed to Boisseau.

“Emmanuel Eboue, who has represented Cote d’Ivoire and is currently registered for the English club Sunderland, is to serve a ban on taking part in any football-related activity that will last for one year or until he pays the total outstanding amount owed to his former agent if this occurs before the one-year ban has elapsed,” an official statement from Fifa reads.

“The origins of the case involve a decision passed by the single judge of the Fifa Players’ Status Committee in July 2013 regarding a contractual dispute according to which Mr Eboue was ordered to pay the players’ agent Mr Sebastien Boisseau an amount owed to him based on the representation agreement between the two parties. The decision was taken on the basis of the Fifa Players’ Agents Regulations in force at the time (2008 edition).

“On 9 September 2014, the Fifa Disciplinary Committee decided to sanction Mr Eboue with a fine of CHF 30,000 (£21,000) for failing to comply with the decision of the single judge of the Players’ Status Committee on the basis of art. 64 of the Fifa Disciplinary Code. The player was also granted a final period of grace of 120 days to settle his debt, upon failure of which the creditor – Mr Boisseau – would be entitled to request that a one-year ban on taking part in any football-related activity be imposed on Mr Eboue.

“Mr Eboue appealed to CAS against the Fifa Disciplinary Committee’s decision, but the appeal was dismissed and the decision of the Disciplinary Committee confirmed in full.

“Following the expiry of the final deadline granted, Mr Boisseau requested that the one-year ban be imposed on Mr Eboue in accordance with the decision of the Fifa Disciplinary Committee. The relevant parties, including The Football Association which has been requested to implement said ban, have been informed accordingly.”

Eboue recently signed a contract until the end of the season with Sunderland. He previously played for Galatasaray, Arsenal, Beveren and ASEC Mimosas.

Ozil: Arsenal Have Themselves To Blame For Title Slip-Up

Featured Image

Arsenal midfielder Mesut Ozil believes they only have themselves to blame for falling behind Leicester and Tottenham in the league.

Gunners were looking to win their first EPL title since the 2003-04 season, only for it to slip away.

Ozil has not given up hope of winning the EPL, believing Arsenal can make up the necessary ground on Leicester and Tottenham with eight games left to play, but he has acknowledged that it shouldn’t have reached this point.

“Looking at our season so far, we have to be honest and admit that we screwed up ourselves,” Ozil told Spox. “We did not play to our potential in the games against the so-called smaller teams. You immediately get punished for that in the Premier League.

“But we still have a chance of winning the title. We have to hope Leicester and Tottenham slip up and then make the most of it.

“I would be delighted for Wenger if we win the title. He played a major role in my decision to join Arsenal. He was desperate to sign me. Everybody knows he is an extraordinary manager. He is always hungry for success, has a lot of experience and always takes his time for the players. He helps players develop.”

Arsenal have been plagued with injuries this campaign and Ozil feels they need to add more depth to their squad if they are to challenge for major trophies again next term.

“We will only see more good players in the Premier League in the future due to the new TV deal,” he added.

“Teams will only get stronger and Arsenal will have to strengthen as well. This season has shown that we struggle when we are missing a number of key players. We cannot allow this to happen again next season.”

Nigeria’s Biggest School Abduction Isn’t #ChibokGirls

Featured Image

Fresh findings have emerged that the dreaded Islamic group, Boko Haram captured hundreds of children from a remote town in Northeast Nigeria in late 2014 but initial calls to report the kidnapping were ignored with locals fearful of the government’s response.

Over 300 children were among the 500 girls, boys and women taken from Damasak by the nefarious death cult on Monday November 24, 2014, a local government administrator, a chief and an elderly resident confirmed to AFP on Wednesday.

READ ALSO: End Of Boko Haram Is Near – Chief of Air Staff

It was gathered that the numbers of those abducted surpassed even the 276 schoolgirls who were taken from Chibok in April the same year, which drew global outrage.

However, the previous administration in March 2015 denied reports of the Damasak kidnapping while a local senator and a senior intelligence source also doubted the claim.

READ ALSO: Boko Haram May Have Lied About Allegiance To ISIS

On Wednesday, March 30, an administrator, whose seven-year-old child was among those abducted, said:

“We kept quiet on the kidnap out of fear of drawing the wrath of the government, which was already grappling with the embarrassment of the kidnap of the Chibok schoolgirls.

“Every parent was afraid to speak out.”

“Locals who managed to flee alerted their political representatives in the Nigerian Senate and House of Representatives but “they kept mute and ignored us”, he said on condition of anonymity.

“The government didn’t want the news out,” he said, explaining that the decision to speak out publicly came after Human Rights Watch (HRW) highlighted the case on Tuesday.

Similarly, the local chief, who pleaded anonymity, said:

“They went to the private school and Islamic seminaries and carted away children as young as five.”

“They also went into town and forcibly seized children from their mothers, children too old to be breastfed. My 16 nephews were among the children kidnapped. They were aged between five and 16.”

Hundreds fled across the river that separates Damasak from Diffa in neighbouring Niger but many drowned, he said, adding that he returned to bury “over 200 dead bodies in mass graves”.

Also confirming the abduction, the Damasak elder said the insurgents killed more than 200 in the initial attack, which happened on a market day.

Findings by HRW from multiple interviews showed that the schoolchildren who were abducted – age between seven to 17 – were initially kept at a primary school, which was then turned into a military base.

However, on March 2015, troops from Chad and Niger liberated Damasak and discovered about 100 bodies in a mass grave under a bridge on the edge of the town.

Countless bodies, including of women and children, were found the following month on the streets, in houses and in the dried-up river.

The reports from HRW and AFP underline the brutality by the Boko Haram sect that has claimed an estimated 20,000 lives and made more than 2.6 million people homeless since its inception in 2009.

This might lead to fresh questions about the previous government’s negligent handling of the insurgency, after its response to the Chibok abduction was condemned as slow and lacklustre.

Nearly two years on, 219 schoolgirls are still being held captive in the dungeon of the Islamic cult.

End Of Boko Haram Is Near – Chief of Air Staff

Featured Image

The Chief of Air Staff, Air Marshal Sodique Abubakar, has declared that the days of the ferocious Boko Haram sect were numbered.

This is just as he expressed optimism that the provisions made for the Nigerian Air Force in the 2016 budget would improve its operations, and put an end to the war against insurgency in the country.

Speaking on Wednesday shortly after commissioning a medical laboratory at the NAF 81 Maritime Group in Benin City, Edo State, the Chief of Air Staff also stressed that the Nigerian Armed Forces is committed to stopping the activities of terrorists in the North East.

He said: “We are at the tail end of the war against Boko Haram. One of their enclaves, Alagarnu, has just been taken over. I was in the North-East a few days ago and I believe that we are at the tail end of this operation.”

“The last time we came, we didn’t have a laboratory. But today, we have a well equipped laboratory. Professionalism is not just about training and equipping the soldier but also taking care of the welfare of the soldier.

“A professional soldier can also fall sick. That is why we need to provide a laboratory, which we have done.”

National Assembly Slates Buhari Over Failure To Assent 2016 Budget

Featured Image

The National Assembly (NASS) has stated that if President Muhammadu Buhari actually said he would not sign the 2016 Appropriation Bill unless it was accompanied by the details, then he is being ungrateful for the excellent job it did on the document.

READ ALSO: Buhari Withholds Assent To 2016 Budget, Seeks Full Details From NASS

NASS expressed regret that the Presidency was unmindful of the herculean task it faced to pass the budget, despite the errors contained in the different versions of the document submitted to the legislature and the litany of disapprovals by some ministers.

Speaking to pressmen on Wednesday in Abuja, the Chairman, House Committee on Appropriation, Dr. Abdulmumin Jibrin, confirmed that the National Assembly did not forward the details of the 2016 budget to President Buhari for assent.

He said it was a regular practice of the National Assembly to send details to the president weeks after passing the budget, saying there was nothing abnormal for the president to sign the budget without seeing the details.

READ ALSO: Senate Passes 2016 Budget | Reduces N6.077trn To N6.060trn

He also gave instance with the administration of former President Olusegun Obasanjo, saying that he (Obasanjo) assented to the budget without the details.

Jibrin therefore assured that details of the budget would be made available to the Presidency within the next two weeks, insisting that from the side of the National Assembly, the budget had been passed.

He said: “There is nothing that has happened so far that is abnormal. Let me put it straight and clear that I doubt that such a statement could come from the Presidency, knowing fully the challenges we went through during the budgeting process.

“Ordinarily, the National Assembly should not have responded to the issues raised but we are duty-bound to put the issues into perspective and put records straight, even though we doubt very much if the Presidency will issue such a statement, knowing the challenges the budget has faced so far.

The general public should note that the MTEF (Medium Term Expenditure Framework) and 2016 budget proposal came to NASS very late. You will also recall that a lot of dust was raised over different versions of the budget circulated in the National Assembly. Further, some ministers disowned the content of the budget during defence before NASS.

Amid these inconsistencies and discrepancies, the NASS had been deeply engrossed in perfecting the anomalies inherent in the 2016 Appropriation Bill. In order for the nation to move forward and avoid stagnation of administrative processes, the tradition is that the bill is passed and forwarded to the Presidency for assent, while the lawmakers continue to work on the details.

“There is nothing abnormal about this practice and yet nothing abnormal about a President assenting a budget before or after seeing the details. In any case, the budget details are usually sent within a week or two after passing the budget.

In view of the inconsistencies, errors, omissions and padding that characterised the 2016 Budget, it would be unpatriotic of NASS to forward the budget details without being extra-careful, meticulous and cautious in discharging its duties. This is to ensure we do not make same mistake that the executive made.

We have been working day and night, we are doing our best, we have been very generous to the executive arm of government. With all these series of challenges in the course of working on the budget, I doubt very much that the executive arm of government or the Presidency, knowing what has transpired in the last few months, will be throwing stones at the National Assembly.

We have instances of President Olusegun Obasanjo signing the budget without the details; we came to Yar’Adua who always preferred to see the details.

For us in the National Assembly, we are trying to make sure that we do not make the same mistake the executive arm made.

Mind you, whatever comes from the executive is a proposal. Maybe, that is why they get away with a lot of things. We cannot get away with such things that they came with because what we are sending to them is practically the law. So, there are lots of differences between what they do and what we are doing.

I have heard people say the President has refused to assent or the President will refuse to assent. We have the power to appropriate and the National Assembly will continue to uphold its power of appropriation as enshrined in the constitution.

There is no place in the world, no country in the world where the executive sends a budget to the parliament and expects that that budget goes back to the executive the way it was sent, it never happened.

So there is no way the details will go back to the executive the way it was sent. We have been gracious enough, we have been generous enough. We sent the envelope the way they brought it, apart from the N17 billion reduction.

The N17 billion was a cut we did from the overheads, which we actually believed that there were lots of things that ought not to be included in the overhead. So we cut off 10 per cent across lines, across all the MDAs, to be able to save that amount of money for the country, otherwise, all the envelopes were left the way they were. Even with that alone, I expect that the executive arm of government should be thankful.

What we have done for the executive arm of government in the last few months since the Buhari’s administration, I think if they are not thanking us, they cannot complain or throw stones at the National Assembly.

He continued: “The 2016 Budget is the most challenging budget the NASS has ever passed in its recent history, taking into account the many controversies and omissions, particularly in NYSC, Prisons, Pensions, personnel shortfalls, among others. The budget failed in many respects to connect with the policy thrust of the government.”

Scottish Wonderkid, Ryan Gauld Frustrated By Sporting Lisbon

Featured Image

Former Dundee United youngster Ryan Gauld admits he is frustrated by a lack of playing time with Sporting Lisbon.

The youngster, who has a 48m pounds buy-out clause, signed a six-year deal in summer 2014, but has made just two first-team appearances.

Ryan Gauld

“I think my development has slowed down a little bit,” he told reporters. “It’s nearing the end of my second year in the B team. To be perfectly honest, it’s not what I hoped for.

“A transfer would be difficult but hopefully in the summer, if I’m not going to be in the first team, then they would be open to me going out on loan.

Here’s a full transcript of his interview

‘It’s nearing the end of my second year in the B team. To be perfectly honest, it’s not what I hoped for. It has slowed down in the last few months and that’s why I was hoping to go out on loan and play first-team games as that would accelerate my development again.

‘Sporting said: “No” when I asked about the possibility of a loan move. There was a bit of interest but Sporting said they wanted to keep me and that’s how it went.

‘They still want me around the training ground and they see me as a future first-team player. That is really positive so I need to trust their word and hopefully they will keep their word.

‘There isn’t long until the end of the season. It’s eight weeks after I return to Portugal. So we will see what’s going to happen next season. I need to get back and do pre-season training and prove I’m ready for a first-team place.

‘The main thing for me is starting pre-season and trying to kick on and be a lot more involved with the A Team.’ Gauld will not wait around forever to make it in Lisbon, however.

‘Sporting don’t spend a lot of money on players so they still see me as an investment,’ he said.

‘So a transfer would be difficult. But hopefully in the summer, if I’m not going to be in the first team, then they would be open to me going out on loan.

‘That would help me to develop more. But I would need to sit down with them and see what they think is best, so I’d just go with the

Athletic Bilbao are considering making Aymeric Laporte their highest-paid player in a bid to keep the Manchester City target at the club, reports AS.

Aymeric Laporte, who is set to miss the rest of the season with a broken ankle, has been the subject of strong speculation in recent weeks, with reports in both England and Spain claiming that Manchester City will meet his €50m buyout clause to sign him in the summer.

Barcelona and Bayern Munich are also on his trail, while Chelsea and Manchester United were keen on him last year.

Athletic are desperate to keep hold of the Frenchman and are considering offering him a new and improved deal, despite the fact he extended his contract last June.

Breaking News : Sunderland Terminate Emmanuel Eboue’s Contract

Featured Image

Sunderland have terminated Emmanuel Eboue’s contract after FIFA suspended the right-back for one year over a failure to pay his former agent.

Eboue signed a short-term Sunderland deal until the end of the season earlier this month, and the club said in a statement today: “The suspension relates to a monetary dispute between the player and a former agent, which precedes his time at Sunderland AFC and was not something that the club was made aware of by the player.

“Eboue signed a contract with Sunderland AFC until the end of the current season and the club has therefore given notice of its intention to terminate the contract. The player has two weeks in which to appeal this decision.”
