One, the idea of the spirit of the law is underappreciated. Maybe the concept is restricted to law school but what it means is to understand that little in life can be captured in black and white. The spirit of what a procedure, a provision, or process means becomes a powerful guide, sometimes liberating us from the rigidity that comes from written words. It is the spirit of governance and the social contract between citizens and their representatives that makes it possible for Britain and three other countries to exist without a written constitution. It is our refusal to examine and insist on the essence of an idea or policy that allows, for instance, public officers to run rings round the code of conduct bureau.

Over time the sense of obligation under a social contract between people and their representatives, give people a sense of what is expected from government, its institutions and its officers. As such, someone can comply with the letter of a law and not its spirit – it is why the law is often called an ass. Because sometimes the strict application of the law can create an injustice which confounds logic.

Two, many Nigerians confuse the demand for good governance and democratic governance with political opposition. If you dare suggest that an administration has done wrong or could do better or even, heaven forbid, that Nigeria at its current state of development (giant 152 out of 188 countries) deserves more, then you are a demon from the pits of the opposition party. Or…you are a disgruntled reject of the current administration that has not yet accepted the offer to serve them and your remarks are merely the squawking of the scorned. Few, it seems, are able to come to terms with the foreign notion that a Nigerian might simply love Nigeria and want more for him and themselves.

Three, we are in a dangerous place when anyone who advocates in the hope of improving a social issue or protests against something that offends his or her sensibilities is suspected of having a paymaster. Dissent and resistance to abuse of authority or the everyday complacency and entitlement of public officers (which are part of the governance fabric of Nigeria) are vital to any democracy.

Are there people who can only be mobilised with the promise of reward? Of course. Are there people who will come out rain or shine, to stand for their beliefs and values? Absolutely. And to suggest that only the former exists is irresponsible. Particularly in Nigeria where a conscientious citizen is Sisyphus – doomed to watch the illusion of progress constantly rolled back. The million man marches of the Abacha era and the variants used by Obasanjo and Jonathan have made us suspicious, but also discerning, about those who take public stands on issues. There are clues. Such mobilisation is typically not about a challenge, idea or policy but ten times out of ten for the deification of an individual, and lining up, fighting for ‘transport’ and out of sync, comical protest posters are a give away.

However, we have the fight to end military rule and the defeat of Third Term to show us that there are enough Nigerians who care about the country and issues. Who stand by what is right regardless of how unpopular and unsafe their views will make them, only for enlightened self-interest. If we refuse to be discerning and chose to use only the lens of crowds-for-hire to assess everyone who speaks up on any issue, then we do ourselves a collective and lasting disservice to citizen action.

Four, we are experts at defending the indefensible. We hold others to low standards maybe for the protection of mutual application when we need to be excused ourselves. In a country where government has completely lost the monopoly over the use of violence as evidenced not only by the war in the North-East but by the casual every-day violence we absorb from machine gun wielding armed men – attacking churches, murdering those who offend us with their words and robbing and kidnapping in broad daylight – we should have zero tolerance for violence. Yet, the most elite class of today, second or third generation educated, beneficiaries of the best education Nigeria had to offer and crowned with exposure of a higher degree abroad, still justify the casual violence of some who claim they are easily provoked by words or the mere presence of others.

Five, history and context is nothing; personalisation is everything. This has to be the reason why many have double standards in assessing different administrations. Our governance structures and practice of democracy are hinged on individuals who loom larger than life – we create tin-gods out of them and we can never look them in the eye, much less scrutinise them. The problems that afflict Nigeria are well known, well catalogued and well discussed. At this time in our collective lives, is this the best we can do? The splitting of hairs around letters of the law and deliberate obfuscation of our context will make it hard for us to admit what we know about our past experience with the single-minded determination of people in and around power and the type of person typically selected to be anyone’s vice anything. Maybe a question to debate is: If the country has six valves were we working at full capacity over the last 103 days? Better still, have our valves ever worked at full capacity?

Finally, my resolve to never be swayed by the braying mob – the tyranny of the majority was strengthened. My appreciation of democracy grew along with my understanding of how valuable the citizen is where the role of active resistance is embraced.

Nigerians who want better must look closely at the political parties and leadership anointment process – half the battle is on that ground. Let’s hold fast to our values and what we believe and if we are indeed from a place of love, compassion and a sense of justice… we can take back our country from those who under the guise of leadership, only want to exploit and abuse him.

Guardiola Calls For Close Of Summer Transfer Window Before Start Of Season

Manchester City manager, Pep Guardiola believes it will do a lot of good, if the summer transfer window closes before the start of a new season.

The transfer sagas still raging on in Europe are causing headaches for clubs, with Coutinho , Van Dijk and Dembele of Dortmund, to mention a few, still making the waves.

And speaking from his own perspective, Guardiola believes closing the window before the start of a season will do a lot of good.

“It would be nice,” he told Sky Sports. “We would start the season with the squad that we would work with until the winter window. Everything would be quicker, less speculation.

“The managers and the clubs would work quicker and not wait for the deadline, the last moment, the last second. So I think it would be better.”

Meanwhile, he does not relish the fact that his side have to tackle Everton in the Premier League’s final match of the weekend.

He said: “I don’t like to play on Monday, the last game, when everybody is done and you play. I don’t like that, but it is what it is.

“I’m considering an opponent like Everton will be tough but I expect a good game – and to win the game, of course.”

Ivorian midfielder, Jean Michael Seri insists he has had any contact with Barcelona about leaving his current club Nice.

The 26-year-old Nice man is highly sought after by Barcelona, who are in desperate need of a replacement for Neymar.

However, Seri, who has a release clause of €36 million has insisted he has not held any talks with the La Liga giants.

“I’m not in contact with anyone,” Seri told ESPN.

“If it happens, it happens. I’m still a Nice player, and we’ll see what happens later.

“I focus on what I have to do. If my agents and Barcelona see each other and talk, I don’t know anything about that.”

Pogba and Martial have both started the season well for United, with the France midfielder scoring in their first two games of the season.

And while Martial wants to win many trophies with his compatriot, both on the club and international level, he is certain he can win the individual award in the next five years.

“We want to win a lot of trophies together at United and we also want to win the World Cup with France,” Martial told MUTV.

Clement Backs Abraham To Deliver

Swansea manager Paul Clement has backed Chelsea loanee, Tammy Abraham to deliver for the Welsh club.

The young forward was on loan last season with Bristol City and scored 26 goals, but has not hit one on target in two matches for Swansea.

However, Clement has faith in Tammy Abraham and believes he will deliver once he gets used to the EPL.

“I think both Tammy and Jordan (Ayew) needed to do better when the ball was played forward to them (against United),” Clement told the Dailymail.

“This was Tammy’s second game at this level, aside from two substitute appearances at Chelsea. He is now starting Premier League games.

“It is going to be a brilliant learning experience for him, but at the same time he is not here on work experience.

“He is here to deliver. He knows that and I am sure it is a matter of time before he is scoring goals.”

Crystal Palace Appoint Dougie Freedman As New Sporting Director

Dougie Freedman has been appointed as Crystal Palace’s sporting director.

Palace is a former Palace striker, manager and assistant manager, and club manager Frank De Boer said: “I always worked with a sporting director during my time as manager at Ajax and I felt this was a position the club needed, I am looking forward to working with Dougie in this transfer window and beyond.”

Dougie Freedman, 43, had two spells as a player at Selhurst Park before taking the reins as manager in 2011.

He went on to have stints in charge at Bolton and Nottingham Forest but now returns to Palace to work alongside De Boer and chairman Steve Parish in the newly-created role.

Parish told Palace’s official website: “This is a position I have been looking to fill for a while, someone to work with the manager, myself and head of recruitment Tim Coe on all the footballing aspects of the club.

“I’m delighted that Dougie has agreed to accept the position and look forward to continuing Crystal Palace’s progression to become a solid Premier League club with the right infrastructure.”

Drama As Smugglers Of Imported Snakes Disappear From Custody

It was all drama as the two suspects – identified as Julius Novigana and Victor Agbor – who were arrested in connection with the smuggling of consignments containing 140 different species of snakes and 660 other animals imported into Nigeria from Cameroon disappeared from the custody of the Nigerian Agricultural Quarantine Services (NAQS) in Cross River State.

Their disappearance was brought to light during the weekend after Mr. Ibrahim Jubril, the Minister of State for Environment, visited to handover the reptiles to the University of Uyo for research.

The minister was told on Friday by Sunday Uket, the Director of the agency that “just two persons were brought here and we have no clue where they have disappeared to.”

The suspects were handed over to officials of the NAQS on July 26 by the Customs Area Comptroller in charge of Calabar Free Trade Zone, Cross River and Akwa Ibom Commands, Mrs. Nanbyen Burromvyat, following their interception.

Apparently appalled following the disclosure, the minister, who said he was not happy with the agency’s poor handling of the case, added that the smugglers would have given information on where they got the reptiles from and where they were taking them to and for what purpose.

“But the agency has messed up the vigilance and good intentions of the Customs service officers who intercepted the consignment,” he said.

However, while handing over the reptiles to the University of Uyo representatives, Jubril said the importers wanted to use Nigeria as a transit point to smuggle the animals to Rotterdam in the Netherlands and Luxemburg, the original destination, as inscribed on the consignments.

“The importers thought they could use the Nigerian water channel or airports to smuggle these reptiles because they considered our airport and water channel as easy transit points for their nefarious activities, but thanks to the Customs for their vigilance; they intercepted the items,” he said.

He said the reptiles had the capacity to wipe out the country’s fauna if released without proper research because of their poisonous nature, adding that it was for that reason that the ministry decided to release them to the University of Uyo to conduct appropriate research.

“We must learn to have the interest of the environment at heart in all our activities. There are many things that these reptiles can do that are both destructive and beneficial to our habitat. So, we must always learn to ensure that we are vigilant at all times to ensure that nobody or organisation imports things that can negatively impact on our environment,” he said.

Jermain Defoe Insists He Is Ready To Start For Bournemouth

Jermain Defoe has revealed that he is “itching to start” for Bournemouth after being named on the bench for the team’s first two matches of the new Premier League campaign.

Defoe joined Bournemouth on a free transfer this summer after leaving Sunderland at the end of last season.

Jermaine Defoe has scored 30 Premier League goals over the last two seasons, but has not yet been included in Eddie Howe’s first XI, with the Bournemouth boss claiming that the striker is lacking fitness.

Burnley have confirmed the signing of Chris Wood from Leeds for a club-record fee of £15 million

The New Zealand international joins the Clarets on a four-year deal.

Buhari Writes National Assembly On Resumption Of Duties As President

President Muhammadu Buhari has written the two Chambers of the National Assembly, notifying the lawmakers of his return from a 103-day medical vacation in London and his subsequent resumption of duty.

The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, made this known in a statement made available to journalists on Monday.

“In line with constitutional provision, President Muhammadu Buhari has written the National Assembly, notifying the legislature of his return to office, after returning from medical vacation in London,” disclosed Mr. Adesina.

In the letter, dated August 21, 2017, the president informed the lawmakers of the senate as well as the House of Representatives, that he was resuming office.

The letter of notice, which was signed by the president, was dispatched to the Senate President Bukola Saraki and Speaker Yakubu Dogara, hours after his nationwide broadcast on Monday morning.

The letter stated in part: “In compliance with Section 145 of the 1999 Constitution (as amended), I write to intimate that I have resumed my functions as the President of the Federal Republic of Nigeria with effect from Monday, 21st August, 2017, after my medical follow-up in the United Kingdom.”

Mr. Buhari returned to the country on Saturday, after leaving the country on May 7.

Meanwhile, It is understood that the president will be working from his official residence, and not his office, for now.

A Presidency source who spoke to State House correspondents on condition of anonymity attributed the development to ongoing renovation in the President’s office.

Akwa Ibom Got Highest, Gombe Lowest As Nigeria Shared N2.8trn In Six Months (See Details)

The Federal Government, 36 states of the federation and the Federal Capital Territory, FCT, have so far shared the sum of 2.788 trillion between January and June this year, the Nigeria Extractive Industries Transparency Initiatives (NEITI) has revealed.

According to the Quarterly Review of the NEITI, which focused on disbursements from the Federation Accounts and Allocation Committee (FAAC), the N2.8tn was shared among the three tiers of government by FAAC in 2017, representing a 38 per cent increase over the N2.019tn shared in the first half of 2016.

In the statement issued on Sunday by Ogbonnaya Orji, director, communications and advocacy, NEITI, it is understood that apart from the federal government that got N1.09 trillion, Akwa Ibom has the highest allocation among the states as it received N92.72 billion within the period under review.

The statement said out of $2.788tn disbursed in the first half of 2017, the Federal Government received N1.09tn; 36 state governments received N923bn; while N549.8bn went to the 774 local governments in Nigeria.

A further breakdown shows that total releases to the three tiers of government amounted to N430.16bn in January, N514bn in February, N496.4bn  in March, N418.82bn in April, N418.82bn in May and N462.36bn  in  June.

Aside Akwa Ibom, nine other states who received the largest allocations are Lagos with N91.45 billion, Rivers comes third with N81.41 billion. The fourth position was Delta with N71.98 billion, while Kano State got the fifth place with N62.90 billion, throwing a derivation state of Bayelsa to the sixth position with N61.45 billion.

Others among the first ten are Katsina State in the seventh position garnering N44.80 billion, Oyo hits number eight with N43.78 billion, Kaduna manages with number nine position with N42.60 billion and the tenth place surprisingly goes to Borno State, with N39.63billion despite the calamities that have befallen the North-eastern state.

The Economic Confidential search (above) further reveals that the states with the lowest allocation from the Federation Account within the period under review are Gombe on the 36th position with N24.87 billion, followed by Ebonyi State with N24.91 billion in the 35th position, Nasarawa State in the 34th position with N25.41 billion.

While Ekiti and Kwara states took the 33rd and 32nd positions respectively with N25.57 billion and N26.48 billion.

NEITI expressed concern that the nation’s debt in relation to revenues may be reaching a critical level.

“However, despite the 38% increase in disbursements in the first half of 2017 when compared with 2016, all the three tiers of government suffered significant revenue decline in terms of projected FAAC disbursement, the statement read.

“Coupled with the low price of oil is the country’s difficulty in meeting the targeted/budgeted production rate of 2.2 million barrels per day.Production has consistently fallen below two million barrels per day since March 2016.

“Thus the double “whammy” of low oil prices and lower production that hit the country since 2014 has remained.”

Neymar has hit out at Barcelona‘s directors, believing that the Blaugrana “deserve much better”.

Neymar left the Camp Nou for Paris Saint-Germain earlier this month for a world record fee of £198m

After PSG’s 6-2 win over Toulouse on Sunday, in which Neymar scored a brace, he suggested that discontent with the Barca board was one of the reasons for his departure.

He told reporters at the Parc des Princes: “I don’t have anything to say to the Barcelona board… well, actually I have something to say. That I am disappointed with them.

“I spent four years there and was very happy. I began happy, spent four years happy and left happy. But not with them.

“For me, they shouldn’t be in charge of Barca. Barca deserve much better, and everyone knows this.”

Finally, Kogi Identifies Strange Disease That Killed 62 People

The Kogi State Government on Sunday said that the alleged strange disease that killed about 62 persons in the state has been diagnosed to be gastroenteritis.

The Commissioner for Health, Saka Audu, while calling for calmness, told the News Agency of Nigeria (NAN) in Lokoja that those so far diagnosed were found to be suffering from gastroenteritis and malaria.

The state Ministry of Health, had in a statement, said that the disease killed many people in Okunran, Okoloke and Isanlu-Esa in Yagba West Local Government Area.

“The current information available to us is that the disease actually started six weeks ago in Okoloke village in Yagba West, which is a settlement that is predominantly inhabited by Fulani herdsmen.

“There have been cases of reported deaths following abdominal pain, vomiting and diarrhoea, but the patients who showed signs of illness had since been evacuated and transported to Kogi State Specialist Hospital Lokoja, for better treatment.

“So far, we have evacuated 39 patients from Okoloke area and only six of them were admitted and have shown significant sign of improvement while others have since been discharged.

“Out of the six that were admitted, three of them were diagnosed of gastroenteritis and the remaining three were just cases of malaria, and they have shown remarkable signs of improvement,” Audu said.

He also stressed that the disease was not Lassa fever, saying the result of samples taken from the patients to Irua General Hospital in Edo State for investigation proved negative.

On the 62 persons earlier reported to have died, the commissioner said the figure was given by local leaders in the affected areas and was yet to be verified by government.

“We will investigate and trace the dead people to the grave yard and come up with the correct figure.

“We want to assure the general public that government is doing all that is humanly possible to stay on top of the situation and forestall further loss of lives.

“We will continue to inform the public as the investigation progresses,” Mr. Audu said.

Arsenal Defenders Carl Jenkinson And Cohen Brammall Set To Join Birmingham On Loan Deals

Arsenal have allowed Carl Jenkinson and Cohen Brammall to join Birmingham City on season-long loan deals.

Jenkinson, 25, who has one England cap, suffered a cruciate knee injury while on loan at West Ham two seasons ago and has not played for the Gunners since.

Bramall, 21, joined Arsenal from non-league Hednesford last January and featured in the club’s pre-season tour of Australia.

Birmingham are hoping to complete the deals today and get them straight in the team.

The double deal continues Arsenal’s clear out of squad players after Gabriel joined Valencia for £10m.

Deportivo La Coruña are also closing in on Lucas Perez on a loan deal with an option to buy next year.

Birmingham have won just one of their four games this season and sit 15th in the table.

ASUU Strike: More Trouble For Nigerian Universities As SSANU, NASU, NAT Meet On Wednesday

The highest echelon of Nigeria’s educational system may be in for a total shut down as lecturers of three major non-academic staff unions of the country’s universities have decided to meet on Wednesday to discuss whether to join the ongoing strike embarked upon by the Academic Staff Union of Universities (ASUU).

Premium Times is reporting that the Senior Staff Association of Nigerian Universities (SSANU) will on Wednesday meet with the Non-Academic Staff Union of Universities (NASU) and the Non-Academic Technicians (NAT), in Abuja to decide on whether to join the ongoing industrial action by ASUU.

In an interview on Sunday, the National Public Relations Officer of SSANU, Abdulsubur Salaam said that the associations have been “pushed to the wall” by the Nigerian government.

“The federal government has been discussing with the academics but we have been reaching out to them since before now and they have refused to heed to us,” he said.

Salaam further listed some of the problems the unions had with the government.

“The issue of staff school that is being negotiated and we are not carried along was agreed on by the four unions in Nigerian varsities; our earned allowances have not been paid too and branches are really heaping pressure on us, especially on the staff school issue.

“So full blown strike may be inevitable as at now. However, we would take that meeting on Wednesday and make a decision on this there.”

Meanwhile, the federal government has revealed that the ongoing strike action by the union may be called off “within the next one week”.

ASUU, an umbrella body of all university lecturers in the country, is currently on strike over the federal government’s failure to fulfil its 2009/2013 agreement with the union.

Marseille Hoping To Sign Arsenal’s Mathieu Debuchy

Arsenal full-back Mathieu Debuchy is a target for Marseille, reports L’Equipe.

The Frenchman is out of favour at the Emirates – he has managed only three Premier League outings for the Gunners since the start of the 2015/16 season.

Marseille are keen on the 32-year-old and could firm up their interest with an offer soon.

The Frenchman, who is under contract until 2019 with the Premier League club, is hoping to reach an amicable agreement with Arsenal officials in order to leave for free.

OM coach Rudi Garcia is familiar with Debuchy after the duo worked together at Lille and will hope the 32-year-old can provide competition for Hiroki Sakai on the right side of his defence.

Diego Costa feels Antonio Conte’s decision to tell him he has no future at Chelsea by text message was a “moment of madness”.

The striker told MC News: “I always asked to speak face to face with the coach and the board. I never sent [them] text messages, so it shows what kind of person he is.

“It was a moment of madness. It can happen, but I thought it was disrespectful.”

‘If something makes me sad about this situation, it’s [the fans’] affection as they’d always supported me, even during the delicate moments.

‘If I’d been in the team for three years, it was for them and the dressing room, which was very much united. It was a great experience.’

The 28-year-old is desperate to leave the Blues this summer and remains in his native Brazil on an extended summer break.

Costa is eyeing a move back to Spain with an Atletico Madrid return in the pipeline but the speculation has not resulted in a formal bid as of yet.

He added: ‘I already have in mind where I want to play and I’ve made it very clear. [Spain’s] a country with which I identify a lot due to the climate and the people.

‘I fell in love with Madrid. We have to wait for the right moment.’

US rapper Jay-Z has finally broken the silence on his alleged feud with Kanye West, speaking openly about being hurt by Kanye’s onstage rant late last year.

The rapper made this known on Thursday during an interview with Elliott Wilson and Brian “B.Dot” Miller on Rap Radar podcast, which streams on his music streaming service, Tidal.

Jay-Z talked about the lyrics of his Kill Jay-Z track on the 4.44 album, that has been assumed to be a diss for Kanye.

His words: “It’s not even about Kanye, it really isn’t. His name is there, just because it’s just the truth of what happened. But the whole point is ‘You got hurt because this person was talking about you on a stage.”

“You got hurt, because this guy was talking about you on a stage. But what really hurt me, you can’t bring my kid or my wife into it. Like, Kanye is my little brother. He’s talked about me a hundred times. He even made a song called ‘Big Brother.’ We’ve gotten past bigger issues, but you brought my family into it, now it’s a problem.”

On November 19, Kanye had called out Jay-Z and Beyonce on stage in one of the concerts at his cancelled Saint Pablo tour.

He had accused Beyonce of refusing to perform at the MTV Video Music Awards unless her video for “Formation” won.

Hov continued on the podcast:

“You know it’s a problem because me and him would have been talked about it, been resolved our issues.”

The podcast marks the first time the 47-year-old mogul has commented on his former collaborator’s tirade.
